On Constitution Day, TPP Reaffirms: Power Must Be Checked

Today is the Constitution Day of the ROC.

Looking back at history, this Constitution endured periods of political tutelage and martial law. It was not until Taiwan moved toward democratization that the Constitution gradually revealed its true nature: protecting the rights of the people and checking the powers of the government.

To solemnly commemorate this, and to restore more holidays to the workforce, the Taiwan People’s Party (TPP) pushed for legal amendments this May to reinstate Constitution Day as a national holiday. However, at this very same time, we observe with great pain that the current rulers are attempting to tear down this temple of democracy.

 

At this moment, the Democratic Progressive Party (DPP) government, for the sake of partisan interest, has thoroughly abandoned the ideals it once championed during the struggle for democracy.

Resting on the fragile foundation of a minority government, the executive branch not only refuses to communicate or cooperate but arrogantly views checks and balances as obstacles and oversight as reactionary. From arbitrarily misinterpreting constitutional articles to the Premier illegally overstepping his authority by capriciously using "unconstitutionality" as an excuse to refuse countersigning laws passed by the legislature; from paralyzing the operation of the Legislative Yuan to manipulating independent agencies—turning the Constitutional Court and the judicial system into political hitmen—the current ruling party is systematically dismantling the firewall of the separation of powers. They are reducing the oversight mechanisms designed by the Constitution into ruins, to be trampled upon at will by those in power.

 

President Lai Ching-te and his administration have openly usurped popular sovereignty. As a "double minority" government—lacking both a legislative majority and an absolute majority of the popular mandate—they should, by the standards of constitutional democratic legitimacy, be more humble and self-restrained. Yet, the Lai administration does the opposite, attempting to grasp unchecked power. Their obstinacy and arbitrary actions are an attempt to establish a new authoritarian regime. When public servants forget who the true masters are, and when the executive power attempts to override the legislative power that represents public opinion, this is not merely a disruption of constitutional governance; it is a regression toward and a restoration of dictatorship.

 

Facing the most severe constitutional crisis since the lifting of martial law, silence is not an option. Taiwan is our cherished country, and this land is the home we rely on for survival. Democracy and freedom were never gifts from the heavens; they are the fruits borne of the blood and tears of countless predecessors. We will absolutely not allow any person or any political party to practice "dictatorship" in the name of "democracy," pushing Taiwan into an abyss of turmoil and division.

 

The authoritarian arbitrariness of the DPP government and its wicked acts of trampling on the constitutional order appear even more absurd and heartbreaking to all who love this land on this Constitution Day. The Taiwan People’s Party vows to stand together with all the people. We will take the most firm and concrete actions to confront this law-breaking, power-abusing government and defend the dignity of the Constitution.

If the rulers insist on acting as enemies of public opinion and continue to let the minority override the majority, the people will ultimately reclaim the power entrusted to you and save their country with their own hands.

 

We will firmly reject "Green Dictatorship," dedicate ourselves to rebuilding constitutional order, defend popular sovereignty, and save our own country.
